Important information for Rehabilitation<\/mark><\/strong><\/p>\n\n\n\n

It is important to note that you can rehabilitate. We constantly communicate with your curator to ensure that you can apply for your rehabilitation as soon as possible. The time period that needs to lapse can vary, but cannot be done prior to 6 months from the date of your sequestration. There is a conception that one can only rehabilitate after 10 years have lapsed. This conception is NOT correct and a MYTH. <\/p>\n\n\n\n

To help ensure a successful rehabilitation, it is crucial to maintain a positive working relationship with your Curator. Follow their requirements carefully, remain in regular contact, and strive to stay informed about the rehabilitation process. This will help you to understand when it may be appropriate to apply for rehabilitation.

When can you apply for Rehabilitation?<\/mark><\/strong><\/p>\n\n\n\n

It is possible to apply for rehabilitation at any point, provided that certain conditions have been met. These include the following:<\/p>\n\n\n\n

\u2013 If an offer of composition has been made and accepted by at least three-quarters of all creditors in terms of number and value, and after payment has been made or satisfactory security has been provided; or<\/p>\n\n\n\n

\u2013 If all creditors\u2019 claims and the costs associated with the sequestration have been paid in full.<\/p>\n\n\n\n

Once these requirements have been met, you may be able to apply for rehabilitation in order to restore your credit rating and other financial privileges.

Six Months<\/mark><\/strong><\/p>\n\n\n\n

It may also be possible to apply for rehabilitation following a period of six months after your sequestration, provided that no claims have been proven against your estate and you have not been convicted of certain offenses. Furthermore, it is important to note that this option is available only if you have not previously been sequestrated.<\/p>\n\n\n\n


Twelve Months<\/mark><\/strong><\/p>\n\n\n\n

In cases where an insolvent individual has not been convicted of certain offenses and has not previously been sequestrated, it may be possible to apply for rehabilitation after a period of 12 months has elapsed from the date of the Master\u2019s confirmation of the first trustees account in the estate. This provides another possible pathway for individuals seeking to rehabilitate their finances and creditworthiness after a period of insolvency.

Three Years<\/mark><\/strong><\/p>\n\n\n\n

It is important to note that if an individual has previously been sequestrated but has not been convicted of certain offenses, they may not apply for rehabilitation until three years have passed since the date of the Master\u2019s confirmation of the first trustees account in the estate. This waiting period is designed to ensure that the individual has sufficient time to address any outstanding debts and demonstrate a sustained commitment to responsible financial management prior to seeking rehabilitation.<\/p>\n\n\n\n


Five Years<\/mark><\/strong><\/p>\n\n\n\n

If an individual has been convicted of certain offenses, they may not apply for rehabilitation until a period of five years has elapsed from the date of their conviction. This waiting period is designed to ensure that the individual has taken steps to address any underlying issues related to their criminal history, before seeking to address their financial history. It is important to note that this requirement applies even if the individual has not previously been sequestrated.

Ten Years<\/mark><\/strong><\/p>\n\n\n\n

If a period of 10 years has elapsed since an individual\u2019s sequestration and no further action has been taken, they are typically deemed to be rehabilitated. Exceptions may arise, however, if a court orders otherwise upon the application of an interested person. It is important to keep in mind that any such application must be made within the 10-year period in order to be considered valid.<\/p>\n\n\n\n
